Introduction to Rosemont Homes Association for New Members

Welcome to Rosemont Homes Association!

Rosemont Homes Association (RHA) is an LLC serving as the homeowners’ association for the nine member properties comprising the association.  The three carriage house condominiums are members of both the Rosemont Condominium Association (a separate legal entity) and the Rosemont Homes Association.  

The By-Laws of the RHA provide the legal framework describing the respective duties and responsibilities of homeowners and the RHA.  In addition, the Association members have certain understandings and agreements regarding the maintenance and use of RHA properties.  

Association Governance

A representative of each homeowner in the RHA serves on the Board of Directors of the Association and holds a single vote on all voting matters before the RHA.  The Board of Directors elects a President and a Treasurer to serve as officers for the LLC. for a period of time as specified by the Board.

Currently, Laura Alfaro serves as President and David Day serves as Treasurer of the Association.

  • Organize, schedule, and conduct RHA Annual Meeting and other RHA special meetings as may be required;
  • Write and distribute Minutes of the RHA Annual Meeting and other RHA meetings;
  • Ensure consistent and fair enforcement of RHA By-Laws;
  • Manage matters that may come before the RHA on an ad-hoc basis (eg: requests for modification of exteriors, etc.) as required by the RHA By-Laws;
  • Represent and protect the interests of the RHA with third parties, including neighbors, government authorities and others.
  • Work with the Treasurer to manage financial affairs of the Association.
  • Maintain the financial accounts of the Association in a sound and responsible manner;
  • Construct annual financial reports (including P&L and Budget), and represent these to the Board for discussion and approval;
  • Ensure all tax returns (Federal and Commonwealth of Massachusetts) are completed and filed in a timely manner;
  • Maintain all insurance policies of the Association, including liability and Director’s insurance as requested by the Board;
  • Pay all property taxes and other obligations of the Association;
  • Complete the annual Corporate Confirmation with the Secretary of State’s office, as required by the Commonwealth.

Since landscaping and snow removal services are, by far, the largest expenditures of the Association, currently the Treasurer has also been overseing, with the assistance of other homeowners, the activities of the landscape/snow removal service provider.

Agreements and Understandings

  1.  Members of the RHA have determined that all landscaping and snow removal services for all properties, with the exception of 55 Rawson Road, should be contracted on an Association basis and funded equally by each homeowner through the annual assessment. Historically, 55 Rawson Road has contracted separately for its Landscaping and Snow Removal services.
  2. Each individual unit is responsible for the cost of maintaining their individual garden spaces, shrubs and small trees.
  3. By agreement with the Town of Brookline, the Association is responsible for maintaining and feeding the large historic oak trees on the property.
  4. The Association pays the property taxes for the common property owned by the RHA and maintains liability insurance for the common property.  Individual homeowners are responsible for their own property taxes and for property and casualty insurance on their individual units. As well, each homeowner is responsible for the maintenance and upkeep costs associated with their individual unit.
  5. The Annual Assessment for all homes with the exception of 55 Rawson Road is $4400/year, payable in quarterly installments of $1100 due on January 1, April 1, July 1, and October 1 of each year.
  6. Special assessments are levied from time to time to fund special projects, such as regular tree maintenance and fertilization, or other property improvements.

 

Per the By-Laws

All homeowners should acquaint themselves with the By-Laws of the Association.  Homeowners are reminded that:

  • Any modification to any exterior architectural element, including but not limited to doors, windows, skylights, electrical and lighting fixtures, patios, driveways, walkways, garage doors must be approved by the RHA before work commences.  Failure to do so may result in a demand by the Association to remove or restore the property to the original condition.
  • Exterior siding and trim paint/stain for all units must comply with the standards set by the Association.  Using unapproved colors or paint/stain manufacturers  may result in a fine for each day the property is in a non-compliant state and a demand by the Association to bring the property into compliance.
  • Homeowners may not plant any tree or shrub or other plant material which will grow to a height of greater than three (3) feet without prior approval of the Association.
  • No sign of any kind (including but not limited to: ‘For-Sale’ signs, political signs, advertising or marketing, or other sign) are permitted to be posted on the property without the prior approval of Association members.
  • All garages must be kept neat and clean and garage doors must be kept closed when your garage is not in use.
